


Constitutional Rights of Texans Are Under Attack
As the CEO of Conservative Republicans of Texas and an advocate for constitutional rights, I urge you to oppose both Senate Bill 30 (SB 30) and Senate Bill 39 (SB 39). These two bills threaten the rights of Texans who have been injured by another person or business. These bills were crafted to protect corporations’ profits by minimizing their liability when their operations cause injuries to individuals. SB 30 and SB 39 must be defeated in the Texas House. Both have already passed the Texas Senate. Contact your state representative today and demand that he or she vote “NO!” on SB 30 and SB 39.

Why SB 30 and SB 39 Must Be Opposed
1. Violation of the Texas Constitution
Both SB 30 and SB 39 undermine Article 1, Section 13 of the Texas Constitution, which guarantees that “All courts shall be open, and every person for an injury done him, in his lands, goods, person or reputation, shall have remedy by due course of law.” This constitutional provision ensures that you and other Texans have access to courts and meaningful compensation for injuries that have been inflicted upon you. SB 30 caps health care expenses, denying full compensation for their injuries caused by corporate negligence, such as refinery workers maimed in explosions or families harmed in motor vehicle accidents. SB 39 was written to “protect Texas trucking,” by restricting lawsuits against trucking companies, shielding corporations from liability for having negligently caused injuries to individuals. The Texas Supreme Court has struck down similar caps on compensation as unconstitutional (Lucas v. United States, 1988). These bills undermine our open courts provision in the Texas Constitution.
2. Texans for Lawsuit Reform (TLR): A Front Group for Corporate Interests
TLR, co-founded by Houston businessman Dick Weekley, is not a grassroots movement, but a front group for corporate interests. Weekley and TLR’s wealthy donors, including insurance companies and corporations, spent over $9 million in the 2024 elections, supporting Republican candidates and legislators, so that they would introduce bills like SB 30 and SB 39 to protect corporate profits over legitimate injury claims of Texans. TLR’s agenda prioritizes shielding negligent corporations, like reckless trucking firms or polluters, from having to compensate for injuries inflicted upon Texans. TLR should be renamed “Texans for Corporate Greed and Immunity,” because it consistently protects corporate interests by undermining the constitutional rights of those harmed by corporate misconduct.
3. Insurance Profits Soar, Yet No Relief for Texans
The Texas insurance industry, a key TLR backer, made an estimated $3.5 billion in profits in 2023 and $6.7 billion in 2024, an increase of over 90%, driven by premium hikes and investment gains. TLR admits that SB 30 will not lower insurance rates, nor will SB 39. These bills are not about helping you, the consumer. These bills shift the financial burden of corporate negligence onto victims, forcing families, healthcare providers, or taxpayers to cover costs, while insurers pocket record profits. SB 30 and SB 39 are about insulating corporations from liability for having caused negligent injuries, enabling them to make more profits at the expense of injured Texans.
4. SB 30 and SB 39 Harm Vulnerable Texans
By capping medical expense recovery, SB 30 punishes uninsured Texans (over 4.3 million, including 623,000 children) and deters healthcare providers from treating them, leaving injured victims of corporate negligence with crushing bills. SB 39 limits lawsuits against trucking companies, even when their negligence causes catastrophic injuries or deaths on Texas roads. It protects corporate profits over families devastated by preventable crashes, undermining justice for those harmed by reckless corporate behavior.
5. TLR’s Influence Threatens Conservative Principles
TLR’s millions in donations, over $9 million to Republican candidates in 2024 alone, buy influence to advance their corporate agenda, not conservative values. By backing SB 30 and SB 39, TLR and Weekley undermine the constitutional rights of Texans to be compensated for injuries caused by negligent actions of individuals or businesses.
SB 30 is pending in the House Judiciary & Civil Jurisprudence Committee. SB 39 has been passed out of the Texas Senate. Its companion bill, HB 4688, has passed the House Judiciary Committee. When HB 4688 comes up for a vote, which could be at any time, SB 39 will be substituted in its place, because it has already passed the Senate. We must act now to protect our constitutional rights and ensure justice for all Texans, not just corporate giants.
