Dr. Hotze and his attorney Jared Woodfill appeared in State Court in Austin, Friday, August 18 on a motion for a Temporary Restraining Order on the Gag Rule and Senate rules in the Paxton impeachment proceedings.

Federal Judge Denies First Amendment Rights to Dr. Hotze.
Hotze appears in State Court today.
On Thursday, August 17, Federal Judge Nelva Ramos ruled that Dr. Hotze did not have standing in the lawsuit, Hotze v The Texas State Senate.
Judge Ramos’ decision effectively denies the plaintiffs’ their Texas and U.S. Constitutional right of political speech and their right to petition the government officials for redress of their grievances. We are grieved that Attorney General Paxton has been impeached and want the Texas Senate to acquit him.
Ramos wrote, “Plaintiffs have not attested that anything about their lives would be different if they did get a communicative response from legislators. Whether legislators agreed, disagreed, or simply commiserated with Plaintiffs, Plaintiffs will not have any greater power to affect the impeachment proceeding from “receiving” communication than they would have by taking the action already available to them of expressing their opinions to representatives and those controlling the process. They have not demonstrated injury in fact.”
The problem with the above line of reasoning is that the senators refuse to listen to the plaintiffs’ grievances. The Gag Rule prevents citizens from engaging their senators in conversations, petitioning them to acquit Attorney General Paxton.

This decision is being appealed to the U.S. Court of Appeals for the Fifth Circuit.

In Texas, liberal Republicans have been losing their power each election cycle. Every legislative session the state moves a little to the right, and the uniparty’s grasp loosens.
Texas is moving to the right in almost every arena due to the successful conservative takeover of the Republican Party of Texas, a historically conservative Texas Senate, as well as increasingly more sophisticated conservative activists and organizations. The GOP voter base is requiring Republicans, regardless of how conservative they actually are, to campaign on policies further right than the status quo. This moves the Overton Window beyond the control of moderate Republicans, who still hold power in the state’s lower chamber.
