Oppose Texas SB 30 to Protect Your Constitutional Rights!
Texas Senate Bill 30 (SB 30) is a dangerous piece of legislation that violates the constitutional rights of Texans who have incurred physical injuries caused by individuals or businesses.
1. SB 30 Violates the Texas Constitution:
Article 1, Section 13 of the Texas Constitution, guarantees “All courts shall be open, and every person for an injury done him, in his lands, goods, person or reputation, shall have remedy by due course of law.” This constitutional provision ensures that you and other Texans have access to courts and meaningful compensation for injuries that have been inflicted upon you.
SB 30 also violates Article 1, Section 15 of the Texas Constitution that guarantees,“The right of trial by jury shall remain inviolate.” It limits the damage compensation that a jury can award an injured victim. Historically and legally juries have been the final arbiters of fair and equitable compensation due an injured individual. SB 30 changes that. It caps health care expenses, denying injured victims full compensation for their injuries.
SB 30 restricts an injured person from being fairly compensated for injuries that they have sustained from an outside party by capping damages. The Texas Supreme Court has struck down similar caps as unconstitutional (Lucas v. United States, 1988). SB 30 puts corporate and insurance company profits over your constitutional right to be compensated for an injury inflicted upon you.
Imagine, while driving in a car with your family, being struck by an 18 wheeler or another type of business vehicle, resulting in serious injuries or death to you and your family members.
How could you you ever be compensated fully and fairly if SB 30 were to pass?
2.SB 30 Places Corporate Greed Before Justice:
SB 30 is backed by Texans for Lawsuit Reform (TLR), better named “Texans for Corporate Greed” or “Texans for Destroying Constitutional Rights.”
SB 30 limits accountability for personal or corporate negligence by capping damages. TLR spent an estimated $9.5 million in political contributions to influence Republican legislators and judges in the 2024 elections. Once elected, TLR gets these Republican lawmakers to pass laws that benefit corporations over your and other Texans’ constitutional right to be compensated for your injuries caused by negligence.
TLR is funded by business interests, corporations and insurance companies, who want to shield themselves from liability claims for negligent actions. Money talks, even to Republican politicians.
TLR is run by Dick Weekly, its liberal co-founder. He routinely supports RINO’s over Christian Conservatives in the Republican Primary. Dick Weekly and TLR were a driving force behind the Texas House impeachment of Attorney General Ken Paxton.
3. Record Insurance Profits, No Rate Relief:
Texas Property and Casualty (P&C) Insurers made an estimated $3.5 billion in profits in 2023 and $6.7 billion in 2024, an increase of over 90%. TLR admits that SB 30 will not lower insurance rates. This bill is not about helping you, the consumer.
SB 30 is about insulating corporations from liability for having caused negligent injuries, enabling them to make more profits at the expense of injured Texans.
SB 30 passed the Texas Senate on April 16. It has been sent to the Texas House Judiciary & Civil Jurisprudence Committee (JCJ) for consideration. This committee will hold a hearing on SB 30 on Wednesday, May 7. To become law, SB 30 must pass both the Texas Senate and House and be signed by the governor.
SB 30 is an assault on your constitutional right to be compensated justly if you have been injured by a negligent party. Please call your state representative today, especially those on the House Judiciary & Civil Jurisprudence Committee, and tell them to vote to protect your constitutional rights by voting NO on SB 30.
